U.S. Supreme Court eases government ability to seize property

In a major decision, the Supreme Court of the United States has expanded the right of government to seize private property for public good by allowing the city of New London, Connecticut to invoke eminent domain and seize homeowners’ property for economic development reasons.

In a closely-divided decision, 5–4, the court determined that the city’s economic development plan constituted a “public use”, and therefore qualified under the U.S. Constitution’s fifth amendment’s Eminent Domain clause.

Justice John Paul Stevens wrote the majority decision, and was joined by Justices David H. Souter, Ruth Bader Ginsburg, Stephen G. Breyer and Anthony Kennedy. “Promoting economic development is a traditional and long accepted function of government,” Stevens wrote, and justified the decision further by saying municipal authorities are better positioned to make decisions regarding a community’s best interests than judges.

Writing the dissenting opinion, Justice Sandra Day O’Connor rejected the economic justification as a public use, pointing out that wealthy individuals are more capable of defending themselves and so are less at risk. But the greatest issue was the likelihood of abuse of eminent domain:

“The specter of condemnation hangs over all property. Nothing is to prevent the state from replacing any Motel 6 with a Ritz-Carlton, any home with a shopping mall or any farm with a factory.” A separate dissent was also included written by Justice Clarence Thomas.

Former science director sues Texas over intelligent design e-mail

Christine Comer, former director of the science curriculum for the Texas Education Agency (TEA), is suing the Commissioner Robert Scott for wrongful dismissal. Comer alleges that she was “illegally fired for forwarding an e-mail about a lecture that was critical of the teaching of intelligent design in science classes.” Her suit alleges she was “terminated for contravening an unconstitutional policy” which required “employees to be neutral on the subject of creationism – the biblical interpretation of the origin of humans.”

The Dallas Morning News reported, “The policy was in force even though the federal courts have ruled that teaching creationism as science in public schools is illegal under U.S. Constitution’s provision preventing government establishment or endorsement of religious beliefs.” Among Comer’s supporters is Philosopher and National Center for Science Education speaker Barbara Forrest who was the presenter at the lecture Comer mentioned in the email.

ISS Expedition 10 returns to Earth

With two space walks, 78 million miles and six months on board the International Space Station under their belts, Commander-Science Officer Leroy Chiao and Flight Engineer Salizhan Sharipov, the station’s 10th crew, landed in Kazakhstan in a Soyuz spacecraft at 6:08 p.m. EDT Sunday.

Also returning was European Space Agency Astronaut Roberto Vittori of Italy, who launched to the Station with the Expedition 11 crew and spent eight days doing experiments. He was aboard under a contract between ESA and the Russian Federal Space Agency.

The re-entry of the ISS Soyuz 9 spacecraft was perfect, returning the astronauts to Earth 53 miles northeast of the town of Arkalyk after 192 days, 19 hours and 2 minutes in space for the Expedition 10 crew. The recovery team reached the capsule in minutes.

They launched from the Baikonur Cosmodrome in Kazakhstan last Oct. 13 at 11:06 p.m. EDT. During their increment they performed two spacewalks, continued station maintenance and did scientific experiments.

Notable accomplishments included replacing critical hardware in the Joint Quest Airlock; repairing U.S. spacesuits; and submitting a scientific research paper on ultrasound use in space. Chiao was also the first astronaut to vote in the U.S. Presidential election from space. The crew completed two spacewalks, including experiment installation and tasks to prepare the Station for the arrival of the new European Automated Transfer Vehicle next year.

Aboard the Station, Commander Sergei Krikalev and Flight Engineer and NASA Station Science Officer John Phillips, the Expedition 11 crew, are beginning a six-month mission. It will include the resumption of Space Shuttle flights and two spacewalks from the Station. Expedition 11 is scheduled to return to Earth on October 7, 2005. The two latest occupants of the station launched with Vittori from Baikonur April 14.

Krikalev and Phillips will have light duty for the next two days, as they rest after completing a busy handover period. For the past week, they have been learning about Station operations from the two men who called the ship home since October. Chiao and Sharipov briefed Krikalev and Phillips on day-to-day operations and gave them hands-on opportunities at Station maintenance. Chiao and Phillips restored the Quest airlock to working order for future spacewalks and practiced operating the Canadarm2 robotic arm.

Solar Power Is Clean Power

Solar power is clean power. Solar energy is the future, and the future is just about to hit you square in the face. The energy generated from the heat or light from the sun will soon power the entire world, all by itself. Solar power, also called solar energy, can be used to produce heat, light, hot water, electricity, and even cooling. It is reliable and efficient, especially now, and as time goes on it will get even better. Solar power is even evident on cloudy days, because much of the sun’s radiant energy can reach you even through the clouds. That’s why so many people get sunburned on overcast days, they play outside all day without sunblock, and end up sunburned.

Solar power is produced by using photovoltaic (PV) cells that capture the energy of the sun and convert it into electricity. The basic units of the system are solar cells, all of which are connected together into modules. Solar power is rapidly becoming the solution for many businesses and home owners who want to control the escalating cost of electricity. Global warming and generous rebates and tax incentives are in the process of ushering in the next wave of alternative energy. Solar power is also currently being widely used by owners of recreational vehicles (RVs) and luxury boats as well.

Solar power is a major player in a sustainable energy plan. In sunny areas, many people have installed panels on their roofs to help with powering their air-conditioning, lighting, and other household necessities; people are beginning to find that the panels pay for themselves. Solar power is an incredible source of power emanating from a practically inexhaustible source – the Sun. It is a form of energy derived from the Sun, which is then converted into electricity or heat. Solar power is actually the heat that we receive from the Sun on a daily basis. The Earth, being placed at a certain distance from the Sun, receives enough light and heat to keep it warm.

Solar power has to be part of the global energy mix. The global power economy is in the early stages of a shift as profound as the shift when gasoline began to be widely used. It is currently heavily dependent on government subsidies to promote rapid introduction and acceptance by mass markets. Solar is an inert process that makes it difficult to compare to other non-inert technologies when comparing costs, considering that current solar modules are generally warranted for a 25 year life span.

Solar power is pollution free during usage. Production end wastes and emissions are manageable using existing pollution controls. The power is made from the sun’s rays, which is completely natural and renewable. Concentrated solar power, also called solar thermal, is a means of gathering solar energy distinct from the use of photovoltaic (PV) panels. Instead of directly converting solar energy to electricity as in PV panels, concentrated solar power concentrates sunlight onto a relatively small point, which heats a medium.

Concentrating Solar Power (CSP) systems use lenses or mirrors and tracking systems to focus a large area of sunlight into a small beam. The concentrated light is then used as a heat source for a conventional power plant. Concentrating solar power systems generate electricity with heat.

How the Army Corps of Engineers closed one New Orleans breach

New Orleans, Louisiana —After Category 4 storm Hurricane Katrina slammed into New Orleans, on the night before August 29, 2005, several flood control constructions failed. Much of the city flooded through the openings. One of these was the flood wall forming one side of the 17th Street Canal, near Lake Pontchartrain. The U.S. Army Corps of Engineers (USACE) is the primary agency for engineering support during such emergencies. A USACE team was assessing the situation in New Orleans on the 29th, water flow was stopped September 2nd, and the breach was closed on September 5th.

California teamsters picket Orange County transit system in contract dispute

In an ongoing labor dispute from May of this year in California, United States, Teamsters Local 952, which represents the Orange County Transportation Authority‘s 1,200 coach operators, went on strike at 12:35 a.m. (0035 hrs) PDT Saturday morning after a cooling-off period declared by State Governor Arnold Schwarzenegger expired.

Sanctioned picket lines have been formed outside Authority facilities in Garden Grove, Anaheim, and Santa Ana. About 200,000 regular passengers are affected.

Major sticking points in the negotiation appear to be related to cost-of-living increases and pension funding allocations. The strike was declared after the Authority’s bargaining agent said he lacked authority to approve a union counter proposal, which he said had to be taken before the OCTA’s board of directors, who will not be available to meet until Monday the 9th at the earliest.

Jawbone found in Aruba is not Natalee Holloway’s

A jawbone found in Aruba is not that of missing American Natalee Holloway, who was a recent high school-graduate at the time of her disappearance. Officials confirmed the news after Dutch scientists completed tests on the bone. The jawbone, which also had a wisdom tooth with it, was found by an American tourist close to the Phoenix Hotel. A second bone had also been found by another tourist earlier this month.

The bone was sent to the Netherlands Forensic Institute where scientists completed tests. They compared the bone to dental records given to them by Natalee’s father, from which they confirmed the the bone was not that of Natalee, although it was human. It was said to be unlikely that the bone was Holloway’s as there is no physical evidence that she was murdered.

Beth accepts the forensic conclusions, is emotionally exhausted from the inexplicably long wait, and deeply disappointed in the time and manner in which she learned of the results.

Taco Stein, the Aruban Solicitor General, released a statement after the announcement was made. He commented on the speed of the identification; he said that they had quickly ruled out Holloway because her records had shown that she had her wisdom teeth previously removed.

Tim Miller, the Director of the Texas EquuSearch, released a statement after talking to Natalee’s father. He said “Dave [Natalee’s father] has been in contact with Aruban authorities and spoke with FBI this morning, the agent working the case. Dave believes it is Natalee.”

An attorney for Natalee’s mother, Beth Twitty, released a statement saying “Beth accepts the forensic conclusions, is emotionally exhausted from the inexplicably long wait, and deeply disappointed in the time and manner in which she learned of the results.” He commented on the Aruban authorities saying that “Apparently Aruban prosecutors were more sensitive to media concerns than the painful vigil of a mother.”

Natalee Holloway disappeared on the island in 2005 while on a school trip. She was last seen leaving a nightclub with three men, one of which was later identified as Joran van der Sloot. Van der Sloot was detained twice by police but has never been charged with Holloway’s disappearance. He is currently in Peru facing a different murder charge. Aruban authorities have said that they are checking neighboring islands to find a match for other missing persons.

Cambridge, Massachusetts —Construction of two condominium buildings and a five-acre park began on March 21, in East Cambridge, Massachusetts. The buildings and park are part of the 45-acre Northpoint development, which will take 15 years and more than $2bn to complete, according to the Boston Globe. The buildings, designated as “Building S” and “Building T” by the planners of the project, Spaulding & Slye Colliers, have been designed by local architectural firm Childs Bertman Tseckares and Architects Alliance from Toronto. Buildings S and T are the first of an eventual 20 buildings planned at the site.

The development will fill what used to be a railroad yard for the Guilford Rail System, a subsidiary of Guilford Transportation Industries. According to Hoovers.com, Guilford is controlled by Timothy Mellon, heir to the Mellon banking fortune. Guilford Rail Systems has its headquarters in North Billerica and owns 1600 miles of railroad throughout New England. The tracks in the Northpoint plot have been removed, though Boston subway’s Lechmere station remains within walking distance of the site, along with parts of Boston and Cambridge. The site is bordered by Route 93 on its eastern side, Monsignor O’Brien Highway to the west, and the Gilmore Bridge to the south.

The landscape architecture of the park is provided by Michael Van Valkenburgh Associates, a landscape architecture firm on Concord Avenue in Cambridge. The firm’s principal teaches in Harvard’s Graduate School of Design. MVVA is also completing the landscape for Harvard’s Northwest Science Building.
